The Social Security system is in place to help us through difficult times. Unfortunately, there are some instances in which the system makes our lives even more difficult than they need to be. Negligent Injury: How To Properly Make Notification To Liable Parties

Getting injured due to negligence is more than just an inconvenience. It can have a variety of negative ramifications on your overall lifestyle, including setting limitations on your ability to earn a living. In cases like these, it is not outside the realm of possibility to file a lawsuit against the individual or business that is responsible for your injuries. When you intend to bring a lawsuit, those being held responsible must be notified about the case. The following are the steps you need to take in order to make proper notification:

Flesh Out Who is Actually Responsible

Before you do anything else, you need to find out specifically who you will be targeting for damages in your lawsuit. This could be one or multiple people, depending on the circumstances of your accident. For example, if you were hurt in a slip and fall due to improper signage, you need to determine if you are suing the owner of the business personally or the business as a whole. If you were hurt in a car accident, you would need to find out who was driving the vehicle. These are things you will need to discuss with your attorney so that your case is not thrown out due to notifying the wrong entity.

Have Your Attorney Write a Letter of Notification

Working with your lawyer, you will need to write a letter of notification. This is a letter that you will use to let those involved in the lawsuit that there will be a case pending against them regarding your injury. You will need to describe your injury in detail, how it happened, and the dates of the incident. It needs to be a letter that is free of emotion; you should not use any language that seems overly emotional or hostile. At the end of the letter, you should request that the defendant respond to your letter to ensure that it was received.

Once that you have decided you are going to file a lawsuit, you need to send the notification letter as soon as possible. While there is not a set time limit on when the letter should be sent, it is best to do so soon after your accident. This will prevent the loss of evidence, whether it is physical evidence or any memories of the incident on which anyone may want to testify.  

If you decide that you do not want to go through with the lawsuit after you have already sent the letter, do not be concerned. It will not affect you in any way.
