What Is The Importance Of Title Examination In Real Estate Law?

Title examination is the process where a real estate lawyer examines the past and present condition of the legal documents for a property. Your goal in hiring a real estate attorney to examine a property's title is to ensure that the current owner is able to transfer it to you without any problems. Here are several examples of why a title examination is important.

Search

Foremost, you want to know that a documentary trail exists for any property before you buy or otherwise acquire it. Generally, a county's records should reflect the history of the deed, tax payments, and survey data for the property.

If there isn't such a history, then that's likely a red flag. Even if a property has a short history because it was carved out of another location through a subdivision, there should be a documentary history through that early period. In most parts of the U.S., these histories will trace back to when the land was either part of a territory or a colony. At some point, every state organized its land for recording purposes so the property's history usually goes back that far.

Chain

The chain of title ownership is also important. If there is a gap in the history, someone might have a rightful claim to the land. Anyone who encounters such a problem can work with a real estate lawyer and the county to cure the title. Typically, the county court will try to fix the issue by stating that the current condition of the title is the only legally accepted one. Curing the title effectively cuts off any competing claims unless someone files paperwork with the court before a judge implements the cure.

Encumbrances

Even if the title is otherwise clean, there may be encumbrances. A common encumbrance comes from a bank while there's a mortgage. Sometimes financial institutions go under or get sloppy, leading to encumbrances never coming off of the title. Once more, you may have to ask a court to cure it.

Mechanics liens are also common. If a previous owner never paid a contractor in full for work on the property, the contracting firm might place a lien on it. Additional encumbrances include easements and impositions from homeowners' associations.

Defects

Finally, there could be an explicit problem with the title. For example, two parties might have open claims to the property. A real estate lawyer can work with the parties to fix the defects or take the issue before a judge.
